Reckless Driving

My son was stopped the other night on suspicion of DUI. I guess he didn't do to good on the sobierty test. He called me and I went to the station before any tickets were written. I talked to the cop, no breathlizer was given and he was given a ticket for reckless driving. He is on probation for something non related. Can this reckless driving ticket be considered violation of probation and can he go to prison for this. The cop said its not a violation because traffic and criminal are two different things. He was never charged or arrested for DUI. I don't know whether to believe the cop or get a lawyer. The cop said he was already doing him a favor. But no test was ever given.

while it is a lot better than a DWI, your son really should consult a local attorney (get a local attorney) who goes into that particular municipal court A LOT.

My office handles traffic matters. I would suggest you hire an attorney who will be able to help with the traffic ticket because reckless driving carries stiff penalties.

39:4-96. A person who is guilty of reckless driving and be punished by imprisonment in the county or municipal jail for a period of not more than 60 days, or by a fine of not less than $50.00 or more than $200.00, or both.

On a second or subsequent conviction he shall be punished by imprisonment for not more than three months, or by a fine of not less than $100 or more than $500, or both.

Getting a reckless driving ticket will not violate your son's probation. However, a conviction for reckless driving will result in heavy fines, five points on his driver's license, potentially a loss of his driving priveleges (I saw someone in court this morning who had his license suspended for 30 days for reckless driving) and potentially some jail time.
