Legal Question in Traffic Law in New Jersey

Reported Traffic Accident

On July 6, 2004 I rear-ender a vehicle which caused no visible damage. The officer at the seen checked it as a reportable accident. On September 28, 2004 I received the bill for a total of $396.32 which covered the total cost of the other vehicle and paid it in full. Recently I ran my Driver History and found the accident on my record. 39:4-130 the driver of a vehicle or street car involved in an accident resulting in injury to or death of any person, or damage to property of any one person in excess of $500.00 shall by the means of communication give notice of such accident to the local police department. My question to you is it possible for the officer to submit an amendment to have the accident change form a reportable to a non-reportable accident? Also it has been 11 months since the accident occurred, and the accident posted on my Driver History on March, 08 2005

Re: Reported Traffic Accident

If there was an officer at the scene of the accident, then you should not have any record of a conviction for 39:4-130. This statute is for failing to report an accident, and you apparently did report it. You should contact DMV down in Trenton and ask for a hearing. When you get the hearing, explain to them the facts of this case and ask them to remove the 39:4-130 notation from your driving history. If you have any other questions about this or any other type of legal matter, please call me at 908-272-0111. There is never any charge for simply talking to me about a case. Thank you.
