Re: School Bus

The statute regarding passing of school buses, 39:4-128.1, does not mention any exemption to the law for emergency vehicles, so in the absence of an exemption the law presumably applies. In addition to this, the law covering emergency vehicles, 39:4-91, says the driver of any emergency vehicle must drive with due regard to the safety of all persons. However, this is a rather unusual scenario, so there may very well be exemptions not specifically noted in the statutes. On the face of it though, it appears that emergency vehicles must yield to school buses discharging or loading children.
