Legal Question in Traffic Law in New Jersey

My son is in rehab at present. But I found tickets from just before he went in. All NJ

1.driving while suspended liscense.

2. driving with no car insurance

3.careless driving

4.CDS in MotorVehicle

I'm sure he won't be driving for years, but what else are the possibilities ?. His liscense was suspended just back in Oct 2012.

It's tough to answer this without knowing what he is suspended for snd gown many times he has been guilty to that charge in the past. Jail time is a possibility.

There can be jail if the number of offenses mount up.

You should notify the court that he is in rehab, so no warrants will ensue, although there may be many now.

You really need an attorney experienced in these matters to help you sort it out.

If he was using a car in your name, you can sustain fallout as well, and that is why you have to take action.

The penalties depend on how many times in the past he has been convicted of driving while suspended and driving with no insurance. If he has been convicted of either in the past then he is looking at mandatory jail time of one length of time or another if he is convicted again. He is also looking at further suspension of his driver's license of one year minimum as well as two motor vehicle points for the careless driving. In addition to this, if he hwas charged with CDS in a motor vehicle then that means he also has a criminal charge of possession of CDS in addition to these traffic summonses. As you can see from the other attorneys' answers, your son faces serious problems. Get your son to a lawyer immediately. He may be facing arrest for failing to respond to these tickets; he has to deal with that. These charges are either very serious or possibly extremely serious with jail time.
