Legal Question in Traffic Law in New Jersey

Speeding - 39:4-98 - 41 in a 25

Good morning...no tickets orpointsin the last 10 years - driving came up upon (which I now know) was a traffic cop. He put his lights on - I inched around him and he pulled me over...asked me if I kneww the speed limit was 25..I replied ''ok''..did not admit wrong..just said I was having a conversation with my daughter who just got an A in Math - he went back and subsequently wrote me a ticket.

It carries a 2 point violation - can this be knocked down to a nonpoint violation? How much would that cost me in fines?

it depends upon the township and the officer. The fee for appearing would depend upon the locale of the summons.

Yes and your fines will be $439. This is an unsafe driving ticket and you only get 2. The 3rd one carries 2 points.

It may be possible to get this reduced to a no-point ticket, however, based on your driving history, it will most likely be less expensive (see other attorneys' replies for fines) to just take the 2-points.

The solution is to talk to the prosecutor and get him or her to agree to reduce or change the charge to a no pointer. You could try doing it yourself or you could hire me for $300.00. The most commonly used no point violation that is used as a substitute charge has fines and costs of a little over $400.00 because it includes a state surcharge in the amount of $250.00.
