Legal Question in Traffic Law in New Jersey
speeding in nj
I was charged w/driving 68 mph in a 50 mile an hr zone in North Brunswick. However, when i received my ticket, 1 side of ticket had the violation at going 1-14 mph over limit & other side had me going over 15 mph over limit. Is the inaccuracy of the handwritten ticket worth going to court to try to have the case thrown out ?

You should fight it because it will probably be cheaper for you to get an attorney to fight the case then to take the points and deal with your insurance company.
I'm right by North Brunswick and would be more than happy to discuss the case with you. Call my office at 732/247/3340 to discuss the case.

You should definitely go to court as you may not get the ticket thrown out (as you put it) but you may get the charge reduced and avoid some (and if lucky all) of the points.
Re: speeding in nj
What the officer wrote in the handwritten section of the ticket is the speed he is accusing you of going. If that is at least 15 miles per hour over the speed limit then you have a 4 point ticket. Anything up to 14 miles per hour over the speed limit is two points on your license. It is not grounds for dismissing the ticket by the court, but it may be grounds for taking the case to trial to try and clarify what the correct speed is. EIther way I would not recommend just paying the ticket. If you, alone or with an attorney, go to court then there is a good chance the prosecutor will reduce the points you are looking at. If it is a two point ticket, you can probably handle it on your own. If it is a four point ticket I would advise you to at least consult with a lawyer. I am an attorney who has handled very many cases similar to yous in various courts throughout NJ in the past. Please contact me to discuss your case. I never charge for simply talking to a person about their case. Thank you.
