In order to convict you of an offense, the police and prosecutor must be able to prove the case against you. In a speeding ticket situation, the proof of your guilt would consist of documentation showing that the radar was working properly and had been tested both before and after you were stopped. They also have to show that the operator of the radar, the state trooper, was properly certified to operate a radar gun. Usually they don't even provide that evidence to citizens like you. They expect you to just pay the ticket or, at worst, go to court and try to work out a reduction of the points with the prosecutor. If you really want to fight this or make sure that everything is done properly then you should hire a lawyer who is trained to do these types of cases. I am an attorney who has handled many cases similar to yours in various courts in New Jersey in the past. If you live in Virginia I can arrange it so that you don't even have to appear in court if it looks like they have the eveidence to convict you and we need to work out the best plea bargain for you. We can do it by afidavit in that case. As far as just getting the ticket dismissed, that would all depend on what the evidence shows. Contrary to popular opinion, the officer is not required to show you his radar readout. The unclear ticket does not help you at all, but we can review the radar equipment/operation. In most cases, however, the equipment is properly maintained an operated.You are usually also issued a reckless driving ticket if going this fast, so at least that is one break you have already received.

More importantly, at this speed, you will likely have your NJ license or operation privileges suspended and will face fines/points. If you are very fortunate, we can do the whole matter by affidavit without your needing to appear. While that is common in many case, I think the judge will probably want to personally address someone driving 40 miles over the speed limit and will not permit plea by affidavit, but we can try.

Driving 106 mph in a 65 mph zone carries 5 points if found you are found guilty. You should contact an attorney to discuss the penalty and possible increase in your insurance premiums as a result. If you require an attorney to defend you in this matter, please contact me.

I recommend you slow down while driving, and bring your toothbrush with you to your court date.
