Legal Question in Traffic Law in New Jersey
Storeage and Towing fee on towed car due to a not guilty citation.
Hi,
I had car towed due to the citation by a cop as my car was register in different state..Anyway I reasons for the above and I was not guilty of all the charges and I did not pay a dime in fine.
But I had to pay $1200 for storage and towing for a private company.And my court date was postponed due to bad weather and I have incurred in excess for storage. I am wondering if I am entitled to pay this amount when I am not guilty of any citation.

Here's a practical response to your question. Lets say the police were wrong and you should get your money back? How would you go about doing it? You won't get very far on your own and it would cost you 10x the amount you have to pay to get an attorney. This is just one of those things where it was an unlucky situation but I just cannot see what you will possibly do about it.
Keep this in mind, just because you were found not guilty or whatever the situation was, doesn't mean the cops lacked the probable cause to take the action they did. Thus, if they were right to take the car in the first place, you have no where to go. Furthermore, I don't understand why you couldn't just get your car right out?
Its just a very odd situation.
