suspended lic.

if you have a suspended DL from a Dui and get caught driving b/c of an accident is it possible to stay out of jail?

Yes, it is possible if you fight it. If you get found guilty or you plea to it, then the SLAP program is your only hope. Thus, I strongly suggest you get a good attorney ASAP.

Driving while suspended for dwi has the ADDITIONAL PENALTY of one to two years further driving suspension and at least ten days and no more than ninty days in jail.

The best you can expect is a ten day jail sentence served on the sheriff's labor assistance program where you serve one day a week by working eight hours that day for the county sheriff.

I forgot to tell you the worst case scenario. If another person suffered personal injury in the accident You will have to serve forty-five to 180 days in jail.

The law calls for imprisonment in the county jail for 10 to 90 days for the violation you describe. There may be a possibility for some alternative to k=jail, such as a r=form of community service, however. If you are facing this charge please contact me.
