Legal Question in Traffic Law in New Jersey
Old suspension ticket & bench warrent
I have a ticket for driving on the suspended list. Thinking it was an era that i was on the suspended list. Later after having my wallet stolen with my DL included, a cop freind informed me my DL was suspended for an older fine at the time of that traffic stop and that I had a bench warrent. Its been 2 yrs my wallet has been recoverd and my DL was still in it but expired. I have payed the older fine that caused my DL to be suspended, and want to renew my DL And take care of this driving on the suspended list matter. How much will the bench warrent be and will there be any jail time. Its my 1st driving on the suspended list offense.

Unlikely there will be jail since your wallet was stolen and this may have contributed to the failure to appear in court (however, this also depends on whether you have a history of bench warrants, if you did, you probably would have mentioned it). Anyway, the bail amount is usually in the hundreds (not thousands) of dollars for first timers. You do face a possible suspension of 6 months, however; and you may be fined by the judge for having been a bench warrant (contempt). The amount of that fine also varies by circumstances and jurisdiction. You may call me, I will be able to determine these amounts better if I have more info. and am able to contact the court.

In New Jersey, in order for you to get your license reinstated you would have to (1) post bail for the outstanding warrant, (2) appear in the municipal court where the "warrant" ticket was issued, (3) resolve by having it dismissed (if not you) or otherwise plea or try the case, (4) go to Motor Vehicles in Wayne or Trenton and pay the restoration fee.
After you pay the restoration fee, your license will be reinstated. If your license expired you need to renew your license after you restore it.
