Legal Question in Traffic Law in New Jersey
tailgating
I just received a complaint from an individual saying i was tailgating. I was not issued a citation by any police officer. Is this something i can defend myself in court and what are the possible penalties i face? thank you

Re: tailgating
This is a five point ticket. If you plead guilty or are found guilty of this charge you will have to pay high fines and you will have those five points on your license. You need to fight against this. I am an attorney who has handled many cases similar to yours in various courts in NJ in the past. Please contact me to discuss your case in more detail. I never charge for simply talking to a person about their case. Thank you.

Re: tailgating
Following too closely involves 5 points and possible loss of license if convicted. A citizen may have signed a complaint. Of course, dealing with people in such circumstances is better using a buffer of detached professionals so the answer is YES definitely hire an attorney to defend you--your record is also a consideration both before and after the alleged offense.
Re: tailgating
A conviction for tailgating means five points on your driving record and a significant increase in car insurance rate for three consecutive years. This is important enough for you to hire an attorney.

Re: tailgating
I agree with the other attorneys, you should really consult with an attorney about these charges. It should not be that tough to defend yourself against something like this since the ticket was issued by a citizen and not an officer. However, the 5 point risk is far too great to just wing it and hope for the best. You really have to fight this with everything you got.
