Legal Question in Traffic Law in New Jersey
Ticket Re: Vehicle Abandonment
My brother, who went to the Philippines in June 2004 left his car with me to sell. It has ND plates on it which expires this month. I disposed of the car 1st week of March but about the middle of Feb. 2005, it was given a ticket saying ''abandonment--vehicle snow covered''.The car was parked on my street and it was not snow covered. It was a mandatory court appearance and since I work nights, I missed the court date which was for 3/17/05. Last night, I got a court order in my mailbox addressed to my brother saying there is a warrant for his arrest and a bail is set for $250.00. Since my brother is not here, am I obliged to answer the court order and if not what are the ramifications of this in regards to my brother's record in case he comes back. Thanks, a speedy reply is most appreciated.

Re: Ticket Re: Vehicle Abandonment
Although legally you have no responsibility for any of this, since we're talking about your brother here you may wish to take care of it for him. Call the court where the sumnmons and arrest warrant were issued from, explain the situation to them, offer to pay the fine, and most likely they will lift the warrant for your brother's arrest. Otherwise, he is subject to arrest anywhere in the U.S. when he returns. You should take care of this soon. If you have any questions you can call me at 908-272-0111. Thank you.
