Legal Question in Traffic Law in New Jersey
i was going across the toll bridge and the officer and his vehicle wasnt in site isnt that intrapment i was in nj coming to pa when it happen
1 Answer from Attorneys
half the time the Officer is never in Site. Generally, for example, N J State Police will sit in areas where they cannot be seen usuing a radar device to clock the speed of vehicles in an effort to catch drivers exceeding the speed limit. The fact that you did not see the Officer will not work as a defense. If you received a motor vehicle summons, you are dealing with a motor vehicle offense not a criminal charge. Entrapment will not help you in fighting a motor vehicle ticket. Maybe you have a different argument but that one will not assist you with a traffic summons.
