Legal Question in Traffic Law in New Jersey
Traffic accident
I was in a traffic accident in a mall parking lot early Jan. and was given a ticket for failure to observe a stop sign, with a required court appearance, i hired a lawyer, and paid him, he told me he would enter a plea of not guilty and get the ticket reduced to careless driving with 0 points, i havent recieved any further information about the case from him yet, and when i called him he said its being taken care of, i got a notice in the mail on Feb. 17th from him stating that he would not be able to represent me in my case and would not be seeing me in court on Feb. 15th. (two days before i got the letter) i called him, and he ''was not in the office'' i called the court house, but because it was the weekend they were closed, what should i do? is a warrent going to be issued?

Re: Traffic accident
As others have said, go the court and explain to the prosecutor what happened.
FYI-there is no 0 point careless driving ticket. Careless driving is a 2 point ticket. Drop me a note at [email protected] if you'd like to discuss this further. I handle traffic offenses on a very regular basis.
Re: Traffic accident
Call the court and tell the clerk your story and follow up with a letter to the judge of the court.
You should include your receipt for paying the lawyer's fee.

Re: Traffic accident
Go to Court on the scheduled date and tell the Prosecutor what happened. Try to swing your own deal to get a no-point plea bargained violation. If you get it, you're done. If you are not satisfied with what you can get on your own, tell the Judge what happened and ask for a postponement to get another lawyer. It is likely you will get one.
As to the lawyer, send him a certified letter asking for your money back. If he refuses, you can make a complaint to the Fee Dispute Committee.
Keep in mind that this advice is given based on the little bit of information that you have
provided in your question. My advice may change based on other information. Further, no one
can rely on advice from an attorney who has not been retained. You cannot rely on this advice
because we have not personally met and you have not retained me as an attorney. As previously
stated, if you do not get the request that you are looking for, you should immediately meet with
an attorney for a full consultation before you take any further steps. You may feel free to call me
to discuss this matter in more detail. If you do so, mention Law Guru and your first one hour of
time will be free. Good luck! Rob Gleaner
Re: Traffic accident
You probably will not have a warrant issued so quickly, particularly if the attorney ever entered an appearancee. Genneraly in municipal courts for traffic offenses, your failure to appear in court results in a notice called a "failure to appear". That is sent to the address on your driver's license. If you don't appear after that, then a warrant is issued.
Re: Traffic accident
I suggest you get an another attorney ASAP and then that attorney can help you get your money back for you and resolve the case.
