Traffic Accident - Personal Complaint

I was travelling in New Jersey in December, in New Brunswick. Traffic was heavy and roads were slick. Travelling at about a half a mile an hour I bumped into a car in front of me. The man got out of his car screamed and insisted on calling the police. Police arrive, there are no injuries, no damages, nothing. They send me on my way, saying it was non-reportable. The man I bumped into did not have auto insurance, the police recognized this and had his car towed (this is what the police report said). I received a summons in the mail: the man went into court and filed a ''Careless Driving'' and ''Following too close.'' I live in Michigan, I sent in my statement, police report works in my favor. Considering there was no damage, no injuries, or anything of the sort, and the police made a legitimate decision, do you think these charges will be dismissed?

You are in a tough spot. While there is little likelihood of your conviction, your appearance is mandatory unless the Court dismisses the complaint. You should hire a local attorney to discuss this with the prosecutor, and perhaps remind the other driver that a malicious abuse of process claim might ensue. There is no reason for his filing a complaint since driving without insurance is not affected by your "accident" or who was at fault.

Unless you either appear in court on your own from Michigan, or hire a New Jersey lawyer to represent you in your absence, the charge will not just be dismissed. These two tickets carry 7 motor vehicle points between them so you probably don't want to just pay these tickets. I suggest you hire an attorney to take care of this for you.
