Legal Question in Traffic Law in New Jersey

Traffic stop

Does a cop have tot ell you why he is pulling you over before requesting to see your documents? Also, if he incorrectly fills out the ticket, so it does not match the location where you were pulled over, is it still valid?

Re: Traffic stop

He should, but if he fails to there is nothing that happens to that ticket. Yes, the ticket can be changed at any time. I suggest you talk to an attorney to discuss attacking the substance of the ticket.

Re: Traffic stop

He should tell you why he's pulling you but his failure to tell you does not necessarily make the stop unlawful. He is supposed to state on the traffic summons the general location of the traffic violation which may be different from where he stopped you.

Call me if you like.
