Legal Question in Traffic Law in New Jersey
Traffic Ticket with Incorrect License Plate
I recently received a moving violation for running a red light (4-81). I was also ticketed for not having my insurance card on me. (Grargh, my bad while running a quick errand!) My license number and name are on both tickets, but the plate is incorrect on the moving violation, and the conditions are not filled out on the failure to have documents one. Is there any chance that either of these tickets could be waived for these incompletions? Also, can I do anything without attending the court date? (I have grad school during that time.)

Re: Traffic Ticket with Incorrect License Plate
While this might fly in some states, in NJ, the cop can amend the ticket. Thus, I suggest you get an attorney and let him or her handle the defenses for you. He or she can also deal with the court date.

Re: Traffic Ticket with Incorrect License Plate
This incorrect/incomplete information on the tickets is not enough to get the tickets dismissed. If you don't want to go to court these are both payable tickets, but the 39:4-81 carries two points on your license if you just pay it. If you go to court on these tickets you may be able to get the points reduced. I am an attorney who has handled many cases similar to yours in various courts throughout New Jersey in the past. Please contact me to discuss your case in more detail. I never charge for simply talking to a person about their case. Thank you.
