Legal Question in Traffic Law in New Jersey

My wife was involved in an accident and I am confused with the way the officer handled the situation. She was driving on a County Hwy on April 4, 2012 around 7.30 pm from north to south on 'South Ave', another car made a left turn about 5 feet in front of me. My quick reaction was to avoid the head on collision, so I applied full breaks and try to turn the car away from her, but unfortunately my car skid off the road and sideswiped with a utility pole even though I avoided the collision.

I called 911 and an officer from the Westfield Police Department came to the scene, however after a brief chat with the other driver, he let her go without collecting any of her information. He came to me and requested papers afterwards but I was upset over the whole thing (first accident) and simply responded saying �the other driver was the cause of the accident, since you didn�t collect any information from her, I am not sure the reason why you are requesting information from me.� Officer simply checked my license but did not create a report because of what I said according to him. Is this legal or do you think this officer did not do what he supposed to do? Is the other driver at fault? I need legal help to recover 4K damage, but there were no ticket issues or no injuries. Thank you
