Legal Question in Traffic Law in New Jersey

I work as a delivery driver at a pizza place. Police officers usually get a 50% discount when they order. The other night an officer came in and ordered food but the girl at the counter forgot to give him the discount and he commented about the price. 30 minutes later on my way to a delivery that same officer pulled me over for making an illegal left turn out of the restaurant's parking lot. I am positive the two are related since none of the drivers have ever had a problem before making that left turn out of the store for the ten years it has been open.

If I do decide to fight the ticket should I bring this up or would I be wasting my time?

Was the turn illegal? If so, go to the prosecutor on the scheduled court date and try to negotiate a no-point guilty plea in a plea bargain. If not, fight the ticket on its own merits. In either case, the prior non-enforcement is irrelevant to the current enforcement. No point in bringing up your theories.

Keep in mind that this advice is given based on the little bit of information that you have

provided in your question. My advice may change based on other information. Further, no one

can rely on advice from an attorney who has not been retained. You cannot rely on this advice because we have not personally met and you have not retained me as an attorney. If you have any questions whatsoever, you should meet with an attorney for a full consultation before you take any further steps. Good luck! Rob Gleaner

You should most certainly bring it up. Additionally, I would sign a criminal complaint against the officer for official misconduct. That is too much of a coincidence to just be an officer doing his duty. That will make the cop sweat a bit. And, who knows, he may even lose his job. He certainly deserves to.

The only other thing I would add is that you are swimming here in deep waters. You should have an attorney. I infer from the zip code that you left that this is in Paramus. That is too far from me for me to be able to take on this case, as much as I would like to.

Good luck.

A.
