Legal Question in Traffic Law in New Jersey

Wrong Court Date on Ticket

I recently received a ticket for failing to stop at a red light in Jackson Township, which was true. I went to court on the court given on the front of the ticket but there was no court that day so the clerk issued me a new court date. Do I have any recourse because of this mistake and since I had to drive half an hour each way for nothing?

Re: Wrong Court Date on Ticket

In some municipal courts the court clerks ignore the court date written by the officer and do their, own independent scheduling. Every motor vehicle summons issued in New Jersey advises on the back anyone intending to plead not guilty should advised the court three days before the court date.

If you are thinking of suing the court for your inconvenience you are thinking of wasting your time.

Re: Wrong Court Date on Ticket

You have no recourse. The back of the ticket states that if you want to plea not guilty you should contact the court 7 days prior to the return date on the ticket.

You should however go to the next court date to attempt to reduce the 2 points which a failure to stop at a red light will give you if you plea guilty or are found guilty of the offense.
