Legal Question in Wills and Trusts in New Jersey
Attorney's fee for will
What would be an average fee for a simple will for a senior couple as well as a power of attorney and a living will. They have only a modest home, no savings, and dwindling IRAs. Ages are 79 and 83. They got the bill and are flabbergasted.

Re: Attorney's fee for will
In NJ I would say about 1000 for the will and 150 to 250 for the power of attorney. Of course it all depends on the work that was done and time spent. This is just an average price.
Re: Attorney's fee for will
Keep in mind that you are talking about SIX documents: two wills, two poa's and two living wills. Despite the couple's financial condition, the time is the same for the attorney. It would take at least 3 hours to meet with the couple, draft the documents, and meet again to sign, copy and send out the docs, etc. So the cost should be in the $600 - $1000 range. Perhaps most importantly, the fee should have been communicated from the beginning. And perhaps the attorney should have advised the couple that they can get some or all of these documents prepared free of charge through the county . . . or the kids can help with the cost.
