Beneficary vs. Wills who gets what?

my mom died 4 mo ago, my sis was the beneficary of moms life insurance. the will clearly states that once monies is distrubted the remaining goes to who is on will. my sister is not giving me what is owed. any suggestions????

Berfore you decide to do anything, you should take a copy of your mother's will to an attorney to see exactly what your rights are. If I am close to you, call for an appointment. You do not say if the Will has been probated, who is the Executor, etc. You should contact the Surrogate in the County where your Mom resided when she passed away, to see if there was a probate and who are both the Executor and attorney for the estate. The Surrogate will give you this information and, for a small fee, provide you with a copy of the Will. Then, if you are mentioned, you can contact them and get a status report. The insurance is payable to the designated beneficiary on the life insurance policy...the proceeds would not normally be distributed according to the terms of the will (unless the estate was designated as the beneficiary of the insurance).
