Legal Question in Wills and Trusts in New Jersey
beneficiary rights
I am a beneficiary of part of my relative's estate. I was sent papers to sign waiving my rights to contest it. Don't I have a right to a copy of the will before signing anything? The executor of the will lives in Florida.
Thank you.

Re: beneficiary rights
I would not sign asnything until you get a copy of the Will and review it. You are being asked to waive a right that you may have, but until you know if there will be a claim (usually there will be none), how can you waive it? Insist on a copy of the Will before any documents are signed. Be sure you are getting all that you are entitled to receive. If you have any questions, contact me directly.
Re: beneficiary rights
By NJ court rule you are entitled to Notice of Probate and a copy of the Will.
Do not sign any document until you have been provided with a copy of the Will.
Re: beneficiary rights
i would suggest that you contact the Surrogate's office; the will, if admitted to probate, is a public record.
