Legal Question in Wills and Trusts in New Jersey
More bills than money
I am executor for my ex-husband who has died recently. I have found his assests to be about $5,000 but his credit card bills alone are over $20,000. And the medical bills are still coming in. Can I tell his creditors he left no estate? If not, what do I do? Thank you for your help as I have no money for a lawyer to help.

Re: More bills than money
Hello,
I would notify the creditors that there is insufficent funds
to pay any bills, further, I would mark any new medical bills
i.e. the envelopes, leave them unopened with the words "deceased" on
the outside and return to Sender, most hospitals will then put them into
an uncollectible status.
You should probate the will as well, if you haven't done so and apply for a proctecton
from creditors form. You have to publish this.
the surrogate court will do this. This puts a time limit on things as well.
