Legal Question in Wills and Trusts in New Jersey
Brokerage Account Transfer
My Mom left a will naming executor of her estate and sole beneficiary, which states that I should not be required to furnish bond and I have full authority over the property without further authorization by any court or jurisdiction. My name is on my Mom's brokerage account as authorized to trade, but they want a ''Court Appointment of Exec/Adm dated withing 6 months with a visible seal'' before they will transfer her stock and other accounts. All her bank wanted was a death certificate. Where do I get this document? I've called county court, but they did not know either.

You need to probate your mother's will in order to be appointed as executor. Once the will is probated (not a complicated process in NJ) the Surrogate will send you an Executor's Certificate, which is the document you mention.

You will need to probate your mother's will, which should be done in the County where she was living at the time of her death. This is not hard to do, but an attorney can help you do it more easily and correctly. If the entire estate goes to you, then this should be pretty simple.

when the will is submitted to the Surrogate Court ( to apoint you the Executor) the court will issue a Letter Testamentary; this is the document with the raised seal that was requested.
