Legal Question in Wills and Trusts in New Jersey

Changing Executor of a Will

My parents had their Wills written up many years ago when I was a minor. As a result my older brother was named Executor to their estates. Now that I am an adult, they would like to change their Wills so that I would be executor. My question is - if we draw up a codicil, have it witnessed and notoraized and attach it to the Will, will it be legal? Or, do they need to have an attorney modify the Wills?

Thank you

Re: Changing Executor of a Will

A simple change by Codicil does not require an attorney, but it is better to use one to be sure all appropriate language and formalities are followed and in place, so the original Will is not inadvertently nullified. If that is all that is required, I estimate it could be done for about $100.00.
