Legal Question in Wills and Trusts in New Jersey

hello my name is christopher kelley and i have a question my ex-wife passed away on sunday their was no benitficary they wanted me to sign over my rights at the surrgates office.If i do that what will happen?

Hi there,

I'm sure this is a very difficult time for you, even given that she was your ex-wife. Even so, you should not sign away anything. Your ex-wife's estate would be governed by NJ intestacy laws if she passed away without a will. Ex-spouses are not necessarily entitled to anything from an intestate estate, but you should have your specific facts reviewed before you make any decisions.

Presuming you were divorced and she had no outstanding obligations due you, you are not entitled to share in her estate. Thus, you are required to sign off. On the other hand, if you are still entitled to something, sign nothing except for appointment of Administrator.
