Legal Question in Wills and Trusts in New Jersey
Contest of a will
my exmother inlaw wrote her will 2001, my daughter was born 2005. My exmother inlaw passed 2008. We got divorced 2007. The Executors signed an affidavite stating that there where no other grandchildren born thereafter 2001. It went into Probate June 2008. What can I do to rectify this legally?

Contact the Surrogate's Office where the Will was filed and ask if there's anything you can file with them. They may have a form. Or they may suggest that you need a lawyer to help you. You may also be able to look at or receive a copy of the Will.
If there is anything in the estate, and depending on what the Will says, you should act to preserve any rights and interest that your daughter may have.

The affidavit you are referring to would go to no other CHILDREN being born after the will was written, not grandchildren, I'm sorry . . .
