Legal Question in Wills and Trusts in New Jersey

Credit card debt.

My mother died on 12/21/02. She has a will which my brother is the executor. She did not designate a POA. She has an outstanding credit card bill of $3,000.00. The company keeps sending bills. I keep sending copies of the death certificate. In short. What do I do with this bill?

The bill is an estate obligation, to be paid from the estate assets. I suggest you notify the company that your mother died, and that your brother is to be the executor, so they can contact him directly.

Give the bill to your brother. It is the Executor's responsibility to pay all legitimate debts of the Estate. If your brother has not yet probated the will he should do so promptly. He may need to retain an attorney to help guide him thru the administration process and its requirements.
