Legal Question in Wills and Trusts in New Jersey
my dad recently passed away and left my sister and I each a life insurance policy ,do we still get it even if its not listed in the will? and do we have to share it with my brother even though he is not named on the policies?
1 Answer from Attorneys
If the life insurance policies each named a beneficiary, the policies aand their proceeds are not part of your father's estate and do not pass under the will. They are a contract, and the named beneficiary is the only person entitled to the proceeds. Unless your brother is a named beneficiary, he is not entitled to any of the proceeds. The policy does not have to be listed in the will, and in fact, even if it were in the will, the will would not govern how the policy is paid, except if the policy did not have a named beneficiary.

* If the answers to your question confirm that you have a valid issue or worthwhile claim, your next step should almost always be to establish a dialog with a lawyer who can provide specific advice to you. Contact a lawyer in your county or township.
* Another reason for contacting a lawyer is that it is often impossible to give a good answer in the Internet Q&A format without having more information. The unique circumstances of your situation and things that you may not have thought to mention in your question may completely change the answer. If you want to be sure that you have a complete answer to your question and an understanding of what that answer means, establish a connection with a lawyer who practices in the area of your concern.
