Death intestate

What happens when a person dies without a valid will? Does property automatically revert to the surviving spouse? Can a will bind an adult child to give a sum of money to another adult child if that sum of money does not exist in the assets of the deceased's estate?

If a pereson dies without a Will his or her estate is distributed in accordance with the intestacy statutes (laws that control estate distributions when one dies without a Will). Who gets and how depends upon the size of the estate and the nature of the assets comprising the estate. Your question on a Will and requiring money be paid is a little confusing and requires clarification.
