Legal Question in Wills and Trusts in New Jersey
Distribution of a Will.
My grandmother passed on 5 years ago. Bonds were left to me that are in my name and in my grandmoms name. My mom has possession of them and refuses to give them to me due to a ''promise'' she made to her mom that they would be used only for certain situations. Does she have legal standing for the refusal?

Re: Distribution of a Will.
If the bonds are in joint names (you and your grandmother) then, promise or not, your mother really has no right to hold them or refuse to give them to you.
Re: Distribution of a Will.
Not unless you are a minor (under 18). If you are an adult, the registration in both names makes you the current owner and, if necessary, you can sue your mother for their delivery to you. This is a response to an Internet question and the reply is not intended to be legal advice or as creating an attorney-client relationship. Omitted facts could result in a different reply.

If the bonds are already in your name they are not a part of the estate; you already own them outright. They must be given to you immediately.
