Dying Young

My brother recently passed away. He was 29. He died suddenly and without warning one night in his sleep. He did not have any type of will. According to New Jersey, his assets were his bank account and his car. The car is new and he was still making payments on this car. How is the car considered an asset if he didn't own it? If I wanted to pay off the car, could I put it in my name? or would it still be considered apart of his estate?

I am very sorry to hear of your loss; it is shocking and tragic when someone's life is cut so short.

It would be worth your time and money to sit down with an attorney who does handle estates (my partner does) and get some simple advice as to what needs to be done to transfer the car and bank account, and whatever else needs to be taken care of. You should find an attorney who is fairly close to you, who does a large amount of this kind of legal work.
