My brother is executor of my mothers estate, the house
is sold. I requested to be at the closing and no
told me when or where it was, so I could not go.
My mothers only bills were some 7 credit cards and a
home equity loan. It has been a month and I have not
received my share of the house. Also my brother has
been threating me so I will no longer answer his calls, he and his lawyer have my address and I will
accept his lawyers calls. Before the house closed
my brother left a very very threating message on my
answering machine, in it he said if I did not call
him back he will hold up my money on purpose for a
year and it doesnt matter to him because he will take
out his executor fees and wait for the rest of this
money. I took the tape out and am saving it, in case
I need to see a lawyer, which it is looking like I
may have too. He also refuses to give me a disbursement of funds statement. Can he tie up my
money even though he has copies of all her bills
and all the information he needs to, pay them. And
what about me not being told about the closing?
Also don't I have a right to the disbursement of funds
statement. I have tried to be very nice about this
but now I am upset....please help..

You do need an attorney. It appears that your brother is not acting appropriately or promptly. At the very least, there must be a better flow of information. Seek legal counsel immediately. You may very well need an attorney. There may be a valid reason to dely the disbursement of at least a portion of your bequest. However, that said his conduct is odd and perhaps a breach of his fiduciary duty.
