Legal Question in Wills and Trusts in New Jersey

Executorship

No will upon death of mother-in-law. Children fighting as to who is to be the executor. Does the executor receive somewhat more for the duty out of the estate?

Re: Executorship

An executor (or if there is no Will, the Administrator) receives a commission (fee) for administering the estate. The commission is set by law and is essentially a percentage of the value of the probate estate.

I would caution that if the children are already fighting over this issue, you may want to think twice about getting involved here. To avoid further problems, it may be better to have a disinterested party act as the Administrator

rather than the children.
