Legal Question in Wills and Trusts in New Jersey

I am the executrix of a million dollar estate. It is a simple will with no issues concerning any beneficiaries contesting it. I was originally told by the lawyer that his fee would be $300 an hour. He is now saying his total fee will be $40,000. How could this be possible? It doesn't seem ethical.

You are entitled to a detailed billing. You are entitled to an explanation of what the lawyer has done and what the lawyer still has to do. You are entitled to know what is going on.

A million dollar estate is not that large. Get a second opinion from another attorney, to get some idea of what is happening.

I agree with Robert. Some lawyers charge a percentage of the estate and most, like myself, charge an hourly rate, regardless of the size of an estate, - thousands or millions. Did you get a written retainer agreement? If so, what does it say? If not, this might require fee arbitration if the attorney does not provide a detailed bill, equating to his initial hourly proposal. Without any contest involved and even if tax death and income tax returns were required, this fee can be contested by you. You should sit down with aan Attorney. Attornies in estates either charge by the hour or on a percentage. You should review your retainer agreement. I wouold suggest that you call my office and set up an initial 1/2 hour consultation for free.
