Legal Question in Wills and Trusts in New Jersey

My father and Aunt passed away and have no idea of what I am to inherat along with my other 3 sisters. My problem is the one of said sisters is executor of my fathers estate, but she just says that there isn't anything left. How do I find out if this is true or not. Especially since she just went on a two week vacation to Europe and now has a 2014 Lexus. Please help or guide me. Thank you!

My father and Aunt passed away and have no idea of what I am to inherat along with my other 3 sisters. His will stated that everything was left to my Aunt and when she passes then estate was to be divided to the four of us. My Aunt passed away exactly 18 months later. My problem is the one of said sisters is executor of my fathers estate, but she just says that there isn't anything left. How do I find out if this is true or not since according to my memory my Grandmother left them over one million dollars, life insurance and property and other investments. I need to find out exactly what was left to my Aunt because things just don't add up especially since said sister just went on a two week vacation to Europe, while my Aunt was dying in the nursing home, got rid of all of her clothes before her death and now has purchased a 2014 Lexus. Please help or guide me. I appreciate anything you information you can help me with. I am disabled and live on a limited income and can not afford an attorney unless they except payment from whatever I inherited. Bless and thank you for assisting me through this incomprehensible heartache.

Best wishes,

Joanne Clark

You will need an estates lawyer in the county where your father's estate and your aunt's estate were probated to file a demand for an accounting, requiring the executor to account for what was done during the administrations of the estates. You should do this as soon as possible. The fact that there were substantial assets at one time doesn't mean that there still were by the time your aunt died. The assets may have been used during your father's and your aunt's life times. If you are not alone in questioning what has been done, you and your other sisters may engage a lawyer together.

THIS RESPONSE IS NOT LEGAL ADVICE, SINCE I DO NOT HAVE ALL OF THE INFORMATION THAT WOULD BE REQUIRED, AND I DO NOT HAVE A REPRESENTATION AGREEMENT WITH YOU.

* If the answers to your question confirm that you have a valid issue or worthwhile claim, your next step should almost always be to establish a dialog with a lawyer who can provide specific advice to you. Contact a lawyer in your county or township.

* Another reason for contacting a lawyer is that it is often impossible to give a good answer in the Internet Q&A format without having more information. The unique circumstances of your situation and things that you may not have thought to mention in your question may completely change the answer. If you want to be sure that you have a complete answer to your question and an understanding of what that answer means, establish a connection with a lawyer who practices in the area of your concern.
