Legal Question in Wills and Trusts in New Jersey

Father passed away at the beginning of this year with no will. He has a wife from a second marriage, no children. He has 2 children from his first wife. I want to understand whether the children have any rights to his estate, one of his children still lives in the home. It looks as if the current wife is planning to sell the home and has claimed the deed is under her name - giving her full rights to do as she will with the home.

It's possible that the children have an interest in the father's estate. It really depends on the value of the estate and on how title to their assets was held. If father and 2nd wife owned the house jointly as husband and wife, she automatically became the sole owner upon the husband's death.
