Legal Question in Wills and Trusts in New Jersey

I need to find forms for NJ probate court. My child's father passed away last week and owns approx. 10,000 in back child support. How can I go to the estate and petition for payment?

If he had a Will, it cannot be probated until 10 days after the date of death. All Class "A" heirs (spouse, children, parents) need to be notified when Will is submitted for probate and Executor is appointed. A copy of the Will is usually provided with the Notice and can also be obtained from the Surrogate.If there was no Will someone needs to be appointed as Administrator and this is usually a spouse or adult children. Once someone is appointed (Executor or Administrator) your claim can be submitted for consideration and payment if there are sufficient funds in the estate to pay it.
