Legal Question in Wills and Trusts in New Jersey

''Head of estate not aware of money''

my grandfather passed away and left me in his will. It is stated that I will be able to collect funds at age 21. I will be 21 in two months and contacted who was believed to be the trustee. However her husband died and now has no knowledge of the money that was put away for me. My two questions are can that money be touced by anyone other than me and second how do I find out where this money is invested.

First, go to the Surrogate's Court and get a copy of the Will and inquire whether or not there had been an accounting made by the Executor (either formally or informally). This will give you a starting place. Since you were presumably a minor you might ask your parents directly if they have any knowledge of this matter. If the "Trust" generated income it may have paid taxes or passed the income tax burden on to you by forwarding a K-1. This is primarily a detective job that a knowledgable lawyer may be able to assist you with.

Try to contact the executor and get a copy of the Will. There may be a successor trustee named, and they may be able to give you information. You may also be able to contact the bank where the assets were held, to trace where it might have gone for investment. Contact the State Inheritance Ta xDepartment to see if any returns were filed. This may lead to information. Or, try the Surrogate's Court where the Will was probated.
