Legal Question in Wills and Trusts in New Jersey

My brother was convicted of tax evation and owes alot of back taxes. We are in the process of selling the family home, which was left to my brother, sister and myself. Will the state automatically take my brothers share of the sale of the home? If so, can he for go his share of the house and just split the sale between my sister and myself? Also, can he put his sons name on the deed so his son will get the money from his share of the house? Right now the deed is still in my parents name (they are both decessed). Thank you
