Legal Question in Wills and Trusts in New Jersey

Inheritance of Property

Mother passed away. She was 1/3 owner of a house through an inheritance from her mother. I am an only child. Did I inherit this 1/3 ownership. There was no will. Deed lists my mother as 1/3 owner.

Re: Inheritance of Property

NJ intetsacy (no Will) laws provides that nearest next of kin (you if there was no surviving spouse) automatically inherits her assets.

You should arrange to have a new Deed recorded indicating you as the substitute for your mother.

I can assist in preparing and recording the Deed, and cost will be $75 for the Deed and approximately $40.00 for recording.

Re: Inheritance of Property

It appears that you have now inherited her one-third. However, I would need to review the deed and a will (if any) from your grandmother before I (or anyone) can determine this for sure. You should immediately contact a lawyer to review the situation. If you want me to assist you, feel free to call me at 856-546-8010. Mention LawGuru and your first consultation is free. Good luck!
