Legal Question in Wills and Trusts in New Jersey

inheritance

There is an inheritance with no will and there are surviving siblings. We do have a lawyer and inheritance taxes are about to be paid. My question is, is it up to the state to send out the money to the siblings or the lawyer?

Re: inheritance

Neither the state of NJ nor the attorney 'sends out the money' to the beneficiaries.

The Administrator for the estate is the person responsible for paying the Inheritance Taxes, all other debts and expenses and then making the final distributions to the intestate heirs, according to the NJ intestacy statute. Your lawyer should be able to help answer your question. If he/she can't, you should look for a new lawyer.

The Administrator of the Estate holds the money, pays the debts and taxes, and after the state approves the tax returns, distributes the remaining money to the beneficiaries. Who is the Administrator of the Estate?
