Legal Question in Wills and Trusts in New Jersey

life estate

My mother passed away 2 years ago leaving a life estate(3 family home with 2 apts. rented) to 2(disabled) of her eight children. My brother now claims that rental income after property tax should be divided among all siblings. I don't feel that this was Mom's intention and that she wanted the income used to support the 2 children with the life estate. Does my brother have a right to any of this money?

Re: life estate

Probably not. A life estate if it is done properly leaves the entire property including rents to the survivors indicated on the Deed. A review of the Deed would be necessary to give a formal opinion. You can call for an appointment.
