How long to settle an will in NJ

My father died last year, the closing on his house was 8/1/2006, all bills are paid and accounts closed. The estate is worth less than $80,000 and the lawyer has all the money. How long before the lawyer should release papers and payment to his heirs? He has said he was sending papers out over 1 month ago and again last week. I appreciate your answer.

As with so many situations where the client is out-of-state, it is impossible to tell what the answer to your question is. The house was sold, and the next question is what if anything else needs to be done before the money gets distributed. You are trusting the attorney.

If you wish, you could ask the executor. Or you could possibly have another attorney check on the first attorney, just to get him moving.
