Legal Question in Wills and Trusts in New Jersey

married and seperated legal issue

My wife and are seperated with our present assets divided in an agreement we signed before our attorneys. we both have 'quit' any claims to any future financial assets that we both may make or hold in the future. we do not have any children. my question is this: If I have a last will and testement prepared, will all my wishes such as my parents liguidating my assets and funeral arrangements etc supercede any rights my mate may have as being legally married to me?? a divorce would rectify this issue but for religeous reasons we do not believe in divorce under our present reasons for seperating. thanx for your advice!

Get a divorce.

A divorce is a legal thing, and not a religious thing. If you believe that you are still married in the eyes of God (which is fine, that is a legitimate thing to believe), then think of the divorce as being just a legal adjustment deciding only what the legal rights are for you and your spouse.

Be done with it. Get the legal part over and finished.
