Legal Question in Wills and Trusts in New Jersey
My mother was co-owner on a property with all of her siblings. She passed away in 2009 and my father passed in 2010 without a will. Are we as her children entitled to anything in regards to the property? I should mention that I am currently living in the property and contributing toward payment of the taxes. My father was the administrator of my moms estate, and i was the administrator of his.

Please keep in mind that my response is just a general comment on your question, and not legal advice. I have answered based upon the law of the State of New Jersey where I practice; the laws in other states may be very different, and may result in very different outcomes. Your question and any response does NOT create an attorney-client relationship between you and this law firm. The exact details of your situation and things that you have not mentioned in your question can completely change the response I gave. You can not rely upon what I have written as legal advice, because I do not have all of the information that I need to advise you, I only have the very small amount of information that you put into your question. To get legal advice that you can rely on and use, please contact me directly.
Maybe. I need to see the original Deed and how it describes the owners- tenants in common or joint tenants with right of survivorship. Plus, you do not say if Mom passed away with or without a Will? A review of these documents decides to what extent, if any, the children have an interest in the property. I suspect, without a review, that the children have now succeeded to Mom's share of the property, but only a review of the documents will confirm this suspician.
