My Parent's Estate
My parents died within three weeks of each other in September of 2005 and left the estate to be divided up equally among the 3 of us. An executor, who is not a member of the family was named in the will. He has taken care of everything but has been dragging his feet on the distribution of the assets. In the meantime, my brother died last year. He has one 10-year-old son from a woman he was not married to. We asked that the estate not be redistributed but his share be given to his son. My sister, myself and the executor were denied bond to handle my brother's estate (he died penniless except for his share of my parent's estate. We have asked the executor to make partial distribution to my sister and I and he refuses to do this. He claims that the lawyer will not make distribution of any kind until an executor has been found. My sister and I retained an attorney at the tune of $1500 three weeks ago and all he is doing is playing phone tag with the executor's attorney. We want this resolved so that we can have closure and move on. We are only asking for what is rightfully ours. I think we have been shanked by the executor, his lawyer and our lawyer. We are at wit's end....what should we do?
