Legal Question in Wills and Trusts in New Jersey
personal property
my brother died. was living with some one in her home. his personal items( clothes small belongings ect nothing of great monetary value) are in this home are these hers to do as she pleases or can his family(mom dad ect.) go in and clean her out.

They are his property and form part of his estate. Unless she has a claim for rent or some rent equivalent, she cannot keep his property. If she has any claim, she must make it against the estate, but still return the property.
