Legal Question in Wills and Trusts in New Jersey

Poa

Can I receive compensation for POA duties, including selling a home, settling all bills, and arranging for Medicaid? I am POA for a maiden aunt who lives in NJ, while I live in Pennsylvania. My duties involve travel and handling everything for her admittance to a nursing home.

First, you are not a Power of Attorney. A Power of Attorney is a Document that grants you the power to act on behalf of another. In Pennsylvania the person named to act on behalf of another is an Agent.

Second, can you get paid for doing all the things sure you can. You just have to have the person who made you her agent to agree to it. Assuming that person is mentally competent its like any other agency agreement.

If you have any questions feel free to contact me, the initial consultation is free.

Re: Poa

Your reasonable expenses (travel, etc.) can be reimbursed.

In addition, the statute allows for reasonable compensation for acting as an attorney-in-fact. The estate beneficiaries would have to approve whatever the payment was, and if they didn't agree, then ultimately, a judge would determine what amount of compensation is reasonable, based on an affidavit you would submit to the court, explaining the services you provided.
